ScholarX is committed to protecting the educational records and privacy rights of students in accordance with FERPA principles and international data protection standards.
What is FERPA?
FERPA (the Family Educational Rights and Privacy Act) is a United States federal privacy law that grants parents and eligible students important rights regarding educational records. It establishes that educational institutions must protect the privacy of student records and provide transparency about data practices.
ScholarX voluntarily aligns its data practices with FERPA principles because we believe every student — regardless of country — deserves the highest standard of educational data protection.
ScholarX operates primarily in Pakistan and is not subject to U.S. FERPA legislation. However, we adopt FERPA-equivalent protections as a voluntary commitment to student privacy best practices.
Educational Records We Protect
Under our FERPA-aligned policy, the following types of records are treated as protected educational records and handled with the strictest confidentiality:
- Test scores, quiz results, and practice exam performance data
- Course enrolment history and completion records
- Teacher assessments, feedback, and academic notes
- Learning progress data, mastery levels, and AI-generated performance analytics
- Communication records between students and teachers on the platform
- Disciplinary records, if applicable (e.g. account suspensions)
- Any personally identifiable information (PII) directly linked to academic performance
Student & Parent Rights
In alignment with FERPA principles, ScholarX recognises the following rights for students and parents or guardians of students under 18:
When Records May Be Shared
ScholarX does not disclose educational records to third parties without consent, with the following limited exceptions aligned with FERPA principles:
- School officials with legitimate interest: Teachers and administrators enrolled in the same institutional account may access records necessary for their educational duties
- Parents of dependent minors: Parents or guardians of students under 18 may request access to their child's full academic records
- Legal compliance: When required by a valid court order or applicable Pakistani law
- Health or safety emergency: Records may be shared with emergency services if a student's safety is at immediate risk
- Authorised service providers: Limited technical data shared with providers under strict data processing agreements (e.g. cloud storage, analytics)
We never disclose student educational records to marketing companies, advertisers, or any commercial third parties. Student performance data is never used for advertising purposes.
School & Institution Responsibilities
When ScholarX is used through a school or institutional account, the institution takes on responsibilities as an "educational authority" under our FERPA-aligned framework:
- Schools must obtain appropriate consent from students and parents before enrolling them on ScholarX
- School administrators agree to use student data only for legitimate educational purposes
- Institutions are responsible for ensuring that assigned teachers only access records relevant to their classes
- Schools must inform ScholarX of any changes to student enrolment status within 7 days
- Upon termination of the school account, ScholarX will transfer or delete student records as directed
